Domain Name Infringement

This is not how I wanted to start my Friday morning. I was given a short lesson on domain name infringement when I opened my email this morning. Dear Mr. Mertz:

Re: Rolex Watch U.S.A., Inc.

Domain Name Infringement: “rolexwatchleasing.com”

This firm is general counsel to Rolex Watch U.S.A., Inc. (“Rolex”). Rolex is the owner of the world-famous and federally registered ROLEX trademark.

It has come to Rolex’s attention that you are the registrant of the rolexwatchleasing.com domain. Your registration of this domain name, containing our client’s ROLEX trademark and trade name, is likely to cause confusion and infringes upon and dilutes Rolex’s intellectual property rights.
Well, I figured that others who share my passion for mechanical watches might enjoy leasing rather than purchasing their favoirte Rolex-but you can guess where my letter went. Something to the effect of cease and desist or we will come out to Denver and drag you behind the car!! No, they did not offer to give me a new stainless steel Daytona in exchange for the domain name-must have been an oversight on their part. So much for that idea 🙂

PS If this is the case I am wondering why Go Daddy allowed the domain name registration??? Well, Go Daddy-what do you have to say?

    It’s not GoDaddy’s job to police your actions. Is that what you really want? Someone to look over your shoulder? Isn’t it your job to be responsible and consider the possible ramifications of such a domain name selection? Their job is to be a registrar; yours is to make sure you register a non-infringing name.

    Khyron-You are right. I was ignorant and assumed if they granted the domain, I was good to go! I learned an important lesson 🙂
